Acceptance of terms
Users should be informed that by accessing or using the Select EV website or apps, they agree to be bound by the Terms of Use and related policies (privacy, shipping, refund, etc.). Select EV’s terms state that using the site constitutes a binding obligation, and Select EV emphasises that accessing the platform indicates unconditional agreement to all terms and policies.
Scope & personal use
The platform is designed for personal use by customers.Selling products or engaging in commercial activities is allowed only for authorized and registered sellers.Any unauthorized resale, misuse of data, or commercial use is strictly prohibited.
Eligibility
Only individuals who can form legally binding contracts under Indian law may use the platform. Select EV restricts transactions to persons competent to contract and notes that minors may use the platform only under the supervision of a parent or guardian. Select EV should reserve the right to terminate accounts if a minor is found transacting without supervision.
Account and registration obligations
Users are responsible for maintaining the confidentiality of their login credentials. Select EV’s terms specify that users must keep their display name and password confidential and are responsible for all activities under their account. Select EV similarly requires users to maintain confidentiality and accept responsibility for actions taken via their account. Select EV should require users to provide accurate information and update contact details, and allow the company to suspend or terminate accounts for false information or security breaches.
Communications consent
By using the platform, users consent to receive communications electronically (emails, SMS, push notifications). Select EV notes that users agree to receive communications via electronic records.
Platform as a marketplace
Select EV’s marketplace connects buyers (customers) and sellers (accessory vendors). The company acts as an intermediary and does not control transactions between buyers and sellers. Select EV clarifies that commercial terms (price, shipping costs, payment terms) are offered and agreed to between buyers and sellers, and Select EV is not party to the transaction. Select EV should likewise state that contract fulfilment, warranties and liabilities lie with the vendor.
Product information & accuracy
Select EV will strive for accurate descriptions but cannot guarantee that all product listings, tariffs or availability details are error-free. Select EV reserves the right to correct errors or update information (including pricing and availability) at any time without prior notice.
Prohibited activities
Users must not engage in illegal, abusive or fraudulent activities, upload harmful content, violate intellectual property rights or attempt to compromise the platform. The terms should prohibit misuse of the charging infrastructure or marketplace.
Indemnity & limitation of liability
Users should indemnify Select EV and its partners against claims arising from misuse of the platform or breach of terms. The company’s liability should be limited to the maximum extent permitted by law; for marketplace sales, responsibility for product quality and warranty generally rests with the seller.
Termination & suspension
Select EV may suspend or terminate user accounts or access to services in case of violation of terms, security breach or fraudulent activity, without prior notice. Users may also close their accounts by contacting customer support..
Governing law & jurisdiction
State that the terms are governed by Indian law, and disputes will be subject to exclusive jurisdiction of courts in Rajahmundry, Andhra Pradesh. Select EV’s terms refer to the Indian Contract Act.
Charging Service Liability Disclaimer
Select EV shall not be responsible for any battery damage, vehicle problems during charging, power fluctuations, or issues arising from third-party charging station infrastructure. Users are responsible for ensuring the compatibility and safe use of their vehicles and charging equipment when using charging services available through the platform.
Arbitration Clause
Any dispute, claim, or disagreement arising out of or relating to the use of the Select EV platform shall first be resolved through arbitration. The arbitration proceedings shall take place in Rajahmundry (RJY), Andhra Pradesh, in accordance with applicable laws
Intellectual Property Protection
All intellectual property associated with the Select EV platform, including but not limited to logos, brand name, trademarks, platform design, text, images, and other platform content belong to Select EV. Unauthorized use, reproduction, or distribution of such content is strictly prohibited.
Charging Infrastructure Protection
Any damage caused to charging station infrastructure may result in criminal action under applicable laws. The responsible individual may also be liable for repair costs, damages, and other legal consequences.
